These Terms & Conditions (“Agreement”) govern the use of Eva2z GPS devices, dashboards, mobile apps, and related services (“Services”). By purchasing, installing, or using any Eva2z device or platform, you agree to be bound by these Terms.


1. Definitions

  • Device: Eva2z GPS tracking hardware installed in a vehicle.

  • Services: Tracking, alerts, dashboards, reports, and all features provided through Eva2z systems.

  • Customer/User: Any individual or company using Eva2z products.

2. Lawful Use

Users agree not to:

  • Use the Services for unlawful, harmful, or abusive purposes

  • Interfere with Eva2z systems

  • Violate local, state, or national laws

  • Resell Devices or Services without authorization

Use of Eva2z Services must comply with all applicable regulations.

3. Unauthorized Usage

Users may not alter, tamper, or reprogram Eva2z devices beyond allowed settings.

If a device is:

  • Misused

  • Tampered

  • Unlawfully accessed

  • Stolen

  • Used for fraudulent activity

Eva2z may immediately suspend the Services without prior notice.

4. Customer Responsibilities

Users are responsible for:

  • Proper installation and operation of the device

  • Keeping login details secure

  • Providing accurate account, vehicle, and contact information

  • Ensuring uninterrupted power supply to the device

Eva2z is not liable for failure of device performance due to incorrect installation or tampering.

5. Installation

Eva2z may provide installation assistance through approved technicians, but customers may choose third-party installers at their own risk.

Eva2z is not responsible for:

  • Incorrect installation by third-party technicians

  • Vehicle issues arising from improper wiring/fitment

6. Service Connectivity & Limitations

Eva2z services depend on:

  • Cellular network availability

  • GPS satellite connectivity

  • Internet access

Therefore, alerts or tracking information may not be delivered during:

  • Network outage

  • Poor coverage

  • Technical issues beyond Eva2z control

Users cannot hold Eva2z liable for delays or failures caused by telecom/network issues.

7. Limitation of Liability

Eva2z is not responsible for:

  • Losses due to service outages

  • Damages to property or persons

  • Missed alerts due to network/device issues

  • Loss of business, profits, or opportunities

  • Any incident arising from user’s negligence or misuse

Eva2z liability is limited to device replacement (if under warranty) or refund of unused subscription amount (if applicable).

8. Indemnification

Users agree to indemnify Eva2z from any claim, damage, or legal action arising from:

  • Misuse of devices

  • Violation of these terms

  • Unlawful activity conducted using the device or Services

9. Warranty Policy

Eva2z devices come with a 1-year replacement warranty against manufacturing defects.

Warranty becomes void if:

  • Device is physically damaged

  • Device is opened or tampered

  • Wiring is cut or altered

  • Device is operated beyond intended purpose

Installation charges are non-refundable.

10. Subscription & Renewal

  • First-year subscription may be bundled depending on the package purchased

  • From second year onwards, subscription charges must be paid by the customer

  • If subscription is not renewed:

    • Services will stop

    • SIM inside the device will be temporarily blocked

  • Customer may renew within 3 months without extra charges

  • After 3 months, SIM replacement fees may apply

11. Prior Booking

If customers pre-book a device:

  • Booking amount is non-refundable

  • Remaining amount must be paid at installation

  • If installation is delayed beyond 15 days, the current pricing will apply

12. Service Duration

Eva2z does not guarantee lifetime service.
If services are discontinued or modified:

  • Users will be notified

  • Any unused subscription amount will be refunded on a pro-rata basis

13. Emergency Alerts to Contacts

By using Eva2z:

  • User authorizes sending emergency notifications to relatives/friends whose contacts are added in the app

  • These alerts are transactional, even if the number is registered under DND

14. Assignment

Eva2z may assign rights or obligations under this Agreement.
Users cannot assign this Agreement without written approval from Eva2z.

15. Governing Law & Jurisdiction

This Agreement is governed by Indian laws.
All disputes fall under jurisdiction of Noida U.P. Courts.

16. Entire Agreement

These Terms constitute the complete agreement between Eva2z and the Customer.

If any part of this Agreement is found invalid, the remaining clauses remain enforceable.
